Welcome to our platform ("BiasTrade").
By accessing or using the Service, you agree to the following terms and conditions. Please read them carefully before creating an account or making any transactions.
1. Use of Service
- The Service provides a community-based platform for buying, selling, and trading K-pop photocards, polaroids, and official merchandise.
- You must be at least 18 years old or have parental consent to use the Service.
- You are responsible for maintaining the confidentiality of your account information.
2. User Accounts
- Users must provide accurate and verifiable information during registration.
- The Service reserves the right to suspend or terminate accounts involved in fraudulent or inappropriate activity.
- Users may not share, transfer, or sell their account access to others.
3. Listings and Transactions
- Sellers must upload clear and accurate images of the items they list.
- Misleading listings, counterfeit items, or unauthorized merchandise are strictly prohibited.
- All payments and transactions must be processed through the platform.
- The Service is not liable for damages caused by inaccurate descriptions, delays, or user misconduct.
4. Shipping and Delivery
- Shipping Deadline: Sellers must ship items within seventy-two (72) hours of the order being placed. Orders not shipped within this window are automatically cancelled and the payment authorization is voided.
- Shipping Responsibility: Sellers are responsible for items until delivery is confirmed by the carrier. We strongly recommend using a shipping service with tracking and insurance.
- Buyer Confirmation: Buyers should confirm receipt promptly upon delivery or report any issues within three (3) days of marking the order as delivered.
- The Service is not responsible for shipping delays or losses once the item has been dispatched by the seller.
- Risk Transfer: Upon carrier confirmation of delivery ("Delivered" status), risk of loss transfers to the Buyer. BiasTrade relies on carrier tracking information and is not responsible for verifying actual receipt.
5. Transaction Finality and Buyer Confirmation
Important: Transactions become final after the confirmation period.
- Confirmation Period: Buyers have three (3) days after delivery confirmation to verify receipt and report any issues.
- Auto-Confirmation: If no action is taken within the confirmation period, the transaction is automatically confirmed and the seller receives payment.
- Transaction Finality: Once confirmed (manually or automatically), all transactions are FINAL and non-refundable. BiasTrade is not responsible for any disputes arising after this period.
- Buyers acknowledge that they must inspect items promptly and report issues within the confirmation period.
6. Payments and Payouts
- Platform Role: BiasTrade acts solely as a payment intermediary and marketplace platform. BiasTrade does not take ownership of any items and is not a party to the transaction between Buyer and Seller.
- Payment Processing: All payments are processed securely through Stripe. Sellers must complete Stripe Connect onboarding to receive payments.
- Authorization & Capture: When a buyer completes checkout, the payment is authorized but not immediately charged. The payment is only captured (charged) when the seller ships the item with a tracking number. If the seller does not ship within 72 hours, the authorization is voided and the buyer is never charged.
- Platform Fee: BiasTrade charges a 12% platform fee (minimum $2) on each sale, calculated on the item price. This fee is deducted from the seller's payout. Buyers pay the item price plus shipping with no additional fees.
- Payout Timing: Sellers receive payouts after the buyer confirms receipt or after the 3-day auto-confirmation period. Payouts are processed automatically via Stripe Connect.
- Payout Irrevocability: Once funds are transferred to the seller's account (payout complete), the transaction is irrevocable. Buyers acknowledge that refunds after payout are not guaranteed and may require direct resolution with the seller.
7. Disputes and Refunds
- Dispute Window: Disputes must be opened within the 3-day confirmation period after delivery. Disputes cannot be opened after the transaction is confirmed.
- BiasTrade may, at its sole discretion, attempt to mediate disputes between Buyers and Sellers. However, BiasTrade's decision in any dispute is final and binding.
- Refunds Before Payout: Refunds are only possible before the seller payout is processed. Stripe processing fees (2.9% + $0.30) are non-refundable.
- No Refunds After Payout: Once payout is complete, refunds require the seller's cooperation. BiasTrade is not responsible for recovering funds from sellers.
8. Chargebacks
Warning: Misuse of chargebacks may result in permanent account suspension.
- Buyers who initiate chargebacks through their bank or credit card company instead of using BiasTrade's dispute resolution process may be permanently banned from the platform.
- BiasTrade reserves the right to pursue legal action for fraudulent chargebacks.
- Buyers must use the platform's dispute system before contacting their financial institution.
9. Privacy
- Personal information (email, phone number, address) is collected solely for account verification and transaction purposes.
- The Service does not publicly display or share user contact details without consent.
- Payment information is processed securely through Stripe and is not stored on BiasTrade servers.
10. Prohibited Conduct
Users may not:
- Upload or sell counterfeit or fan-made items.
- Engage in harassment, fraud, or abuse toward other users.
- Use automated tools to scrape, copy, or interfere with the Service.
- Circumvent the platform's payment system or conduct off-platform transactions.
- File fraudulent chargebacks or disputes.
11. Limitation of Liability
The Service is provided "as is" without warranty of any kind.
- Maximum Liability: BiasTrade's maximum liability for any transaction shall not exceed the platform fee collected for that transaction.
- BiasTrade is not liable for:
- Items lost, stolen, or damaged during shipping
- Items not matching their description (buyer's remedy is with seller)
- Fraudulent sellers or buyers
- Chargebacks initiated by buyers through their payment provider
- Any indirect, incidental, or consequential damages
12. Indemnification
Users agree to indemnify and hold harmless BiasTrade, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorney's fees) arising from:
- Your use of the platform
- Any transaction conducted through the platform
- Your violation of these Terms
- Your violation of any rights of another user or third party
13. Changes to Terms
These Terms may be updated periodically. We will notify users of significant changes via email or platform notification.
Continued use of the Service after changes constitutes acceptance of the updated Terms.
